    The 2023 Presidential candidate of the Labour Party, Peter Obi, has described the declaration of state of emergency in Rivers as undemocratic.

    In a reaction on his X handle on Wednesday, Obi said that the action was against the rule of law, and capable of undermining Nigeria’s democracy.

    Obi said that it was grossly unconstitutional to remove a serving governor of a state through a unilateral declaration of state of emergency.

    He said that the situation was capable of undoing the progress the country had made in the past 26 years of its democratic journey.

    “The situation in Rivers does not justify such an extreme measure, it is also a biased interpretation of Section 305(1) of the 1999 constitution.

    “A state of emergency does not mean that an elected governor can be removed unilaterally.

    “The decision does not align with democratic norms and good governance. It appears to be a predetermined action serving specific interests rather than the collective good of Rivers people and Nigeria.

    “This action constitutes an unconstitutional overreach, setting a dangerous precedent that threatens democracy, the rule of law, and the separation of powers,” he said.

    Obi urged the National Assembly and all stakeholders not to allow the decision to stand in the interest of democracy and the wellbeing of Rivers people.

    Lawmakers clash at House of Reps over state of emergency in Rivers

    Two members of the House of Representatives, Marie Ebikake and Blessing Amadi, on Wednesday engaged in a heated argument over the declaration of emergency rule in Rivers State by President Bola Tinubu, on Tuesday.

    Ebikake and Amadi, who represent Brass/Nembe Federal Constituency of Bayelsa and Port Harcourt Two Federal Constituency of Rivers State respectively, started the argument few minutes before commencement of the plenary.

    The two female lawmakers, alongside other members, were discussing the Rivers crisis when they suddenly started shouting and pointing fingers at each other.

    Vanguard reported on Tuesday that Tinubu declared a state of emergency in Rivers State, citing the prolonged political crisis and governance paralysis.

    The President also suspended the Governor, Sim Fubara, his deputy and the members of the State House of Assembly for six months.

    Tinubu said during a nationwide broadcast: “I feel greatly disturbed by the political crisis in Rivers. The state has been at a standstill, and the people have been deprived of good governance.

    “Fourteen months after Governor Fubara demolished the House of Assembly, it remains unbuilt. Many Nigerians have intervened, just as I did. But their efforts have been to no avail.

    “No responsible President will stand by without taking action. To restore good governance and peace in this circumstance, it has become imperative to declare a state of emergency.

    “By this declaration, Governor Fubara is hereby suspended.

    “In the meantime, I hereby nominate Vice Admiral Ibok-Ete Ibas (rtd) as Administrator to take charge of the affairs of the state in the interest of the good people of Rivers State.”

    The declaration came just hours after another explosion was reported at an oil facility in Ogba/Egbema/Ndoni Local Government Area.

    Earlier, on the same day, the Trans-Niger Pipeline, operated by Shell Petroleum Development Company (SPDC), went up in flames, further escalating tensions in the state.

    Suspension: Natasha, Akpabio, Senate, others disagree over plea to vacate court order

    The suspended Senator, Natasha Akpoti-Uduaghan and the Senate President, Godswill Akpabio, on Wednesday, disagreed over the Senate’s application seeking to vacate the order made by a Federal High Court in Abuja on March 4.

    The Senate, in a motion on notice filed on March 17 by its lawyer, Chikaosolu Ojukwu, SAN, had sought an order setting aside Order Number Four, among orders, in the enrolled ex-parte order made by Justice Obiora Egwuatu on March 4 against the defendants in Natasha’s suit.

    Natasha, who represents Kogi Central Senatorial District, had, in a motion ex-parte marked: FHC/ABJ/CS/384/2025, sued the clerk of the National Assembly (NASS) and the Senate as 1st and 2nd defendants.

    Akpoti-Uduaghan also named the President of the Senate, Federal Republic of Nigeria, and Sen. Neda Imasuem, who is the Chairman, Senate Committee on Ethics, Privileges and Code of Conduct as 3rd and 4th defendants respectively.

    The embattled lawmaker had sought an order of interim injunction restraining the Senate’s committee headed by Imasuem from proceeding with the purported investigation against her for alleged misconduct sequel to the events that occurred at the plenary on Feb. 20, pursuant to the referral by the Senate on Feb. 25, pending the hearing and determination of the motion on notice for interlocutory injunction.

    In order number four of the five reliefs she sought which Justice Egwuatu granted, Natasha had sought an order declaring that any action taken during the pendency of the suit is null, void and of no effect whatsoever.
    However, the Senate, through Ojukwu, sought an order setting aside the number four order.

    Ojukwu urged the judge to vacate the order in the interest of fair hearing.

    Citing Action 36(1) of the constitution, the lawyer argued that order number four was interlocutory in nature and ought not to have been granted by the court.

    “It is my submission that the court has made an interlocutory order. The court cannot make an order that will affect the other parties before the end of the case,” he said.

    The lawyer alleged that the court was misled into granting that order among other orders made.

    According to him, the order will offend Section 36(1) which talks about fair hearing
    He therefore urged the court to hold that the entire proceedings of March 4 upon which that breach occured was in nullity.

    Lawyer to the clerk, Charles Yoila; Kehinde Ogunwumiju, SAN, who appeared for Akpabio and Umeh Kalu, SAN, who represented Imasuem, aligned themselves with Ojukwu’s argument.

    But Natasha’s counsel, Michael Numa, SAN, disagreed with their submissions.

    He described their argument as the conspiracy of the defence.

    “We filed an affidavit evidence of 12 paragraphs on March 18 in opposition to the motion on notice.

    “It is accompanied by six exhibits marked as Natasha 1 to Natasha 6D, chronicling the event that happened,” he said.

    The lawyer urged the court to dismiss the defence application and exercise its disciplinary powers on them for alleged contempt of the valid court order.

    He argued that the defendants had, with audacity, disobeyed the order of the court.

    While responding to the argument of Ojukwu, Numa submitted that “parties are bound by the prayers on the motion paper.”

    He urged the court to discountenance the application.

    The lawyer argued that the court must consider the entire orders in their ex-parte motion and not in piecemeal.
    He said their argument was immaterial.

    According to him, the Senate (2nd defendant) did not mention the propriety of Orders One, Two, Three and Five made by this honourable court.

    “The fact that Order Four was made is only an ancillary order to give effect to the motion that until the matter is dispensed with,” he said.

    Numa described the application by the defence as an affront on the court, that the judge should set aside the orders they had not challenged.

    He said the defendants had not even addressed the order directing them to show cause within 72 hours upon the service of the order.

    “This is an invitation to anarchy my lord,” he said, citing previous cases to back his argument.
    “Whatever reservation they have, their only duty is to come to court. The order was that the respondents to come and show the course

    “Their application is self-defeating,” he argued.

    Justice Egwuatu after listening to their argument, stood down the matter for ruling.

    The Peoples Democratic Party Governors’ Forum (PDPGF) has advised President Bola Tinubu to reverse the state of emergency declared in Rivers.

    The Chairman, Gov. Bala Mohammed of Bauchi State, who made the call in a statement on Wednesday in Abuja, described the declaration of emergency rule in Rivers as unconstitutional.

    Mohammed stated that it was illegal and unacceptable for the president to suspend democratically elected officials of a state.

    “The PDPGF has noted with concern the suspension of democratically elected officials in Rivers by the president. We state categorically that this is a threat to democracy.

    “This is a premeditated attack on Rivers, the PDP and other opposition parties in the country. It is a great threat to democracy and an ill wind that will blow no one any good.

    “It is a dangerous course of action that will not only endanger our hard-earned democracy but deepen crisis in the country, ” the statement read in parts.

    The PDPGF chairman further said that the president’s action would exacerbate the crises in the nation, deepen mistrust, elevate security threats, and destroy the economy.

    In a related development, the Nigerian Bar Association (NBA) has described the emergency rule declaration in Rivers as unconstitutional.

    The President, Mazi Afam Osigwe, said in a statement on Wednesday that the declaration of emergency rule remained an extraordinary measure that must be invoked strictly within constitutional limits.

    “The NBA affirms its commitment to upholding the constitution, defending democratic governance, and ensuring that the rule of law prevails in Nigeria.

    “The removal of elected officials under the pretext of emergency rule is unconstitutional and unacceptable,” he said.

    He urged Tinubu to reverse the declaration in the interest of democracy and the well-being of Rivers people.

    Rivers: State of emergency may lead to ‘guerrilla warfare’, host communities warn

    Less than 24 hours after the declaration of a state of emergency in Rivers State, oil and gas-producing communities in the Niger Delta have warned that President Bola Ahmed Tinubu’s decision could trigger guerrilla warfare in the region.

    The communities expressed concerns that the recent bombing of the major Trans-Niger oil pipeline in Bodo, Gokana Local Government Area of Ogoni, Rivers State, on Tuesday may be linked to aggrieved ex-militant leaders who feel sidelined in the pipeline surveillance contracts.

    Speaking exclusively to Vanguard on Wednesday, Joseph Ambakaderimo, Chairman of the Board of Trustees (BoT) of Community Development Committees (CDC) of Niger Delta Oil and Gas-Producing Areas, cautioned that the political crisis in Rivers State could spiral into an economic crisis if not handled with tact and diplomacy.

    Ambakaderimo criticized President Tinubu’s decision, arguing that the situation was still manageable and did not warrant a state of emergency.

    “A state of emergency can lead to guerrilla warfare, and this country is not ready for such a dire situation,” he warned.

    He alleged that some ex-militants involved in pipeline surveillance contracts had been sidelined and might have taken advantage of the crisis in Rivers State to sabotage the pipeline as a means of drawing attention to their grievances.

    “This is why I urge the federal government to urgently review the contracts to ensure inclusivity and fairness for all stakeholders. Reports indicate that out of Train Six of the NLNG, only two are currently operational, which has led to a shortfall in gas supply.

    “If crude oil production suffers a similar fate, the consequences for the national economy will be disastrous. The government must reassess its approach to these contracts, possibly engaging the CDC to mediate with affected groups and communities,” he stated.

    Despite the declaration of a state of emergency, Ambakaderimo called on Rivers State Governor Siminalayi Fubara to seek dialogue with President Tinubu through senior statesmen in a bid to reverse the decision.

    He also condemned the 27 lawmakers in the state for disregarding the Supreme Court’s judgment and prioritizing their own political interests by attempting to impeach Governor Fubara at the behest of their political leader, Nyesom Wike.

    “Governor Fubara has been the only one trying to implement the court’s judgment, even at his own detriment. However, the lawmakers pursued a different agenda—to remove him from office. They outrightly ignored the Supreme Court’s ruling and even refused to accept the budget from the Governor.

    “For me, a state of emergency could lead to a full-blown guerrilla conflict, further exacerbating the crisis. If this happens, daily crude oil production will decline, which would be disastrous for the country’s economy,” he warned.

    Ambakaderimo emphasized that President Tinubu should reconsider his decision, arguing that doing so would align with his administration’s broader goal of ensuring peace and boosting oil production.

    “Rescinding the state of emergency would be a demonstration of the President’s commitment to peace and economic stability. Otherwise, it could amount to shooting himself in the foot,” he concluded.

    “Having already struggled with electoral irregularities, non-adherence to qualification rules, and massive rigging, adding the arbitrary removal of elected officials will push us closer to lawlessness and anarchy.

    “I appeal to the National Assembly and all stakeholders to resist this development. Allowing it to stand will only deepen the existing culture of impunity and brigandage that threatens our democracy.

    “A new Nigeria is possible.”

    The Ijaw National Congress (INC) has described as hasty and lopsided President Bola Tinubu’s declaration of a state of emergency in Rivers State.

    President of the apex Ijaw socio-cultural organisation, Prof Benjamin Okaba, in a chat with Vanguard on Tuesday night in Yenagoa, said: “It is a clear state of dictatorship in civilian clothing.”

    He noted that the crisis would have been averted if Mr. President had reined in his minister, Nyesom Wike, who according to him is desperate to capture state power and resources with a view to turning Rivers State into his personal estate.

    His words, “The few comments we need to make now about the declaration of emergency in Rivers State is one; it is too hasty, secondly, it is lopsided and thirdly we don’t think that it complies with the constitutional provisions.

    “We say it is hasty because the president has so much opportunity to leverage on the calls made by Nigerians from all quarters to call his minister to order. Then secondly, the Wike himself has been the major antagonist as he has boldly stated clearly that he will make governance impossible for Fubara in as much as he does not dance to his tune.

    “And in a recent statement that was credited to him, he said the two conditions he must meet are; allow him control of all the LGAs in Rivers State and that he (Fubara) should sign an agreement he would not contest in 2027.

    “So, it is obvious that the man is desperate in capturing state power, state resources and wants to turn Rivers State into a personal estate and property. And the people of Rivers State are the ones to suffer and the governor who has entered into a covenant with the people of Rivers State to deliver sustainable development cannot mortgage that mandate because you want to satisfy somebody.

    “These are obvious facts flying all over the place and I thought Mr. President should look at all of these. If the stories about him having some tacit support for Wike or providing an enabling environment to advance this cause may be in the interest of all of them up there.

    “I say it is lopsided again because why would you leave Wike and sack Fubara? The best thing to do is to take off everybody that has played a major role and these are Wike in as much as the state governor and deputy governor and assembly are going, Wike should also go. In fact, Wike and all federal appointees from Rivers State should be sacked.

    ”If you don’t sack them, they will use the position they have now to perpetrate more crises and play a more advantageous role to themselves and all these cries that they want to take over Rivers State are just being played out and it is not good for democracy.”

    Continuing, the INC President said: “We have seen right from the beginning that the declaration of state of emergency was one of the options Wike was looking at if the judiciary could not remove him quickly, and if the House of Assembly was unable to take him off. The last option he has is to create a chaotic situation so that an emergency rule can be imposed on the state.

    “So, for Ijaw people, we are not too happy because we feel that this is another slap on us but again as to what our position will be, it will be deliberated upon in a wider stakeholders meeting that will be convened later.

    “The safety and security of Gov Fubara must be guaranteed by the president…. I’m sure Fubara’s security would be in jeopardy now that the military had taken over the reign of power in the state, we must start now to demand that the safety of our son Fubara must be sacrosanct and guaranteed at all cost. The world is watching and I’m sure this is a clear state of dictatorship in civilian clothing! We need the Ijaws worldwide to rise up and place Mr. President on notice should anything wrong happen to our son Fubara!!

    ABUJA: The Peoples Democratic Party (PDP) has rejected the State of Emergency imposed on Rivers State by President Bola Tinubu.

    National Publicity Secretary of the PDP, Debo Ologunagba, in a statement late on Tuesday said the President exercised powers he didn’t possess by removing an elected governor and imposing a state of emergency on the PDP-controlled state.

    Ologunagba said the “PDP and indeed, Nigerians listened with dismay the national broadcast by President Bola Ahmed Tinubu in which the President, in utter violation of the 1999 Constitution pronounced an imposition of a state of emergency in Rivers State.

    “The PDP outrightly rejects this attempt by the President to override the Constitution of the Federal Republic of Nigeria, 1999 (as amended) and undermine the votes and Will of the people of Rivers State by seeking to depose a democratic government and foist an undemocratic rule in the State.

    “The unconstitutional declaration by President Tinubu of the suspension of the democratically elected Governor of Rivers State, Governor Siminalayi Fubara and appointment of an unelected individual, Vice Admiral Ibokette Ibas (rtd) to govern the State is a clear attack on our nation’s democracy, an abrogation of the votes and democratic right of the people of Rivers State to choose their leader under the Constitution.

    “The action of Mr. President therefore clearly borders on attempt at state capture. It is the climax of a well-oiled plot to forcefully take over Rivers State for which the All Progressives Congress (APC) has been bent on stoking crisis to ensure that democracy is ultimately truncated in the State.

    “Nigerians are invited to note that the situation in Rivers State and the reasons adduced by the President cannot justify the declaration of a state of emergency in the State under the 1999 Constitution, rendering the declaration completely incompetent.”

    He further said, “The PDP alerts that the unwarranted imposition of emergency rule in Rivers State is part of the larger vicious plot to foist a siege mentality across Nigeria, decimate opposition, impose a totalitarian one-Party State and turn the country into a fiefdom

    “In any case, nothing in Section 305 of the 1999 Constitution relied upon by the President in the declaration grants him the exclusive powers to declare or execute the declaration of a state of emergency without recourse to the statutory approval of the National Assembly.

    “For the avoidance of doubt, Section 305 (2) provides that “The President shall immediately after the publication, transmit copies of the Official Gazette of the Government of the Federation containing the proclamation including the details of the emergency to the President of the Senate and the Speaker of the House of Representatives, each of whom shall forthwith convene or arrange for a meeting of the House of which he is President or Speaker, as the case may be, to consider the situation and decide whether or not to pass a resolution approving the proclamation”.

    “Mr. President should recognize that his order to an unelected individual to forthwith take over government of Rivers State is illegal and a clear recipe for crisis, threat to the peace and stability of not only Rivers State but the entire nation.

    “For emphasis, Governor Fubara was democratically elected for a tenure of four years which tenure cannot be unconstitutionally abridged.

    “The PDP therefore cautions Vice Admiral Ibokette Ibas (rtd) to respect the Constitution and ensure that he does not take any action or step which is capable of derailing smooth democratic Governance in Rivers State.

    “Nigeria is not under a military rule where the Governance of a State is by appointment by a junta.”

    Former Vice President, Alhaji Atiku Abubakar, has lambasted President Bola Tinubu for declaring a state of emergency in Rivers State following a lingering and unresolved political crisis that led to the bombing of pipeline infrastructure in Rivers.

    Atiku said the development reeks of political manipulation and outright bad faith.

    The former VP blamed the president for the crisis in Rivers, accusing him of being a “Partisan actor in the political turmoil engulfing Rivers.”

    Atiku, who took to X to react to the development shortly after the president suspended Governor Siminalayi Fubara, his deputy and members of the state House of Assembly in a nationwide broadcast on Tuesday, March 18, 2025.

    Tinubu said, “I feel greatly disturbed by the political crisis in Rivers. The state has been at a standstill, and the people have been deprived of good governance.

    However, in his reaction, Atiku said it is disgraceful that the president refused to stop the crisis from escalating.

    “Anyone paying attention to the unfolding crisis knows that Bola Tinubu has been a vested partisan actor in the political turmoil engulfing Rivers.

    “His blatant refusal or calculated negligence in preventing this escalation is nothing short of disgraceful.

    Beyond the political scheming in Rivers, the brazen security breaches that led to the condemnable destruction of national infrastructure in the state land squarely on the President’s desk.

    “Tinubu cannot evade responsibility for the chaos his administration has either enabled or failed to prevent,” Atiku said.

    Continuing, the former Vice President said it is a failure on the part of the president that the Niger Delta region has been thrown back into era of unrest, adding that the president should bear responsibility for the bombing of pipeline infrastructure in the region.

    “It is an unforgivable failure that under Tinubu’s watch, the Niger Delta has been thrown back into an era of violent unrest and instability — undoing the hard-won peace secured by the late President Umaru Yar’Adua. Years of progress have been recklessly erased in pursuit of selfish political calculations.

    “If federal infrastructure in Rivers has been compromised, the President bears full responsibility. Punishing the people of Rivers State just to serve the political gamesmanship between the governor and @officialABAT’s enablers in the federal government is nothing less than an assault on democracy and must be condemned in the strongest,” Atiku stated.
